By entering the Free Shipping Tuesdays Contest (the “Contest”), entrants agree to abide by these Official Contest Rules and will be deemed to have received, understood and accepted the Official Contest Rules by participating in the Contest. The decisions of Canada Post Corporation (“Canada Post”) with respect to all aspects of the Contest are final and binding.
The Contest is sponsored by Canada Post. The Contest and your participation in the Contest are subject to all federal, provincial and local laws and to these Official Contest Rules. These Official Contest Rules do not provide any warranties for the Contest and limit Canada Post’s liability.
1.1 The Contest will run from October 1, 2021 at 12:01 am Eastern Time to October 31, 2021 at 11:59 pm Eastern Time. A random draw will be made in Ottawa on or about November 22, 2021 by Canada Post or an agent of Canada Post from all eligible entries received on or before October 31, 2021. Following the draw, all tentative winners will be contacted by the email or telephone number registered to their Solutions for Small BusinessTM account.
1.2 The chances of being selected depend upon the number of eligible entries received.
2.1 The Contest is open only to Canada Post Solutions for Small BusinessTM members who are legal Canadian residents, and who, at the time of entry, have reached the age of majority according to the law of the province or territory in which they reside, except employees of Canada Post, its affiliated companies, advertising agencies, other representatives or agents and members of the respective immediate families of such employees and anyone with whom such employees are domiciled.
3.1 Each Canada Post Solutions for Small BusinessTM member will automatically receive one (1) entry into the Contest
3.2 You may earn additional entries into the Contest in two ways:
i. Earn one (1) entry for every parcel item shipped using your Solutions for Small BusinessTM account number between October 1, 2021 and October 31, 2021.
ii. Mail-in entry/No purchase necessary: You may enter the Contest without purchase by mailing an original handwritten letter, at least one hundred (100) words in length, explaining what winning the prize would mean for your small business, along with your full name, Canada Post Solutions for Small BusinessTM account number, address (including postal code), age, email and daytime telephone number (including area code) to:Canada Post
3.3 To be eligible:
i. Parcel items must be properly deposited using your Solutions for Small Business account number.
ii. Mailed entries must be postmarked by no later than 11:59 pm Eastern Time on October 31, 2021, the Contest closing date. Mailed entries are subject to the same entry conditions, eligibility requirements and other terms and conditions applicable to other entries. One mailed entry per envelope with sufficient postage.
3.4 No other forms of entry, submission or means of transmission or delivery will be accepted. No responsibility is assumed by Canada Post for any lost, late, damaged, destroyed or misdirected entries or for any faulty electronic data transmission, equipment failure or other online communication problems occurring in connection with participation in the Contest.
3.5 All entries are subject to review for eligibility. Entries which are mechanically reproduced, fraudulent, illegible, altered, mutilated or tampered with will be declared invalid. Incomplete entries or entries that do not comply with these Official Contest Rules will be declared invalid. Entries become the property of Canada Post and will not be returned.
4.1 A total of two (2) prizes of free shipping credits are available to be won. The maximum value of each parcel shipping credit is $10,000.00. One prize will be awarded to an existing Canada Post Solutions for Small BusinessTM member (account registered before October 1, 2021) and the other prize will be awarded to a new Canada Post Solutions for Small BusinessTM member (account registered between October 1, 2021 and October 31, 2021).
4.2 Parcel shipping credits will be applied to the prize winner’s account within forty-five (45) days of November 22, 2021 unless the prize winner has a pre-existing debt, in which case there will be no credit applied to the account until the debt is fully paid. For greater certainty, any Canada Post Solutions for Small BusinessTM who wins a prize may not use an awarded credit to pay down or clear a pre-existing debt owed to Canada Post. All unused prizes expire on November 30, 2022, and winners are expected to use the allocated prizes before this end date or advise Canada Post accordingly.
4.3 The prizes may not be redeemed for cash. The prizes must be accepted as awarded without substitution and are not transferable. Canada Post reserves the right, in its sole discretion, to substitute another prize or component of a prize of the equal or greater value, without liability, in the event that the prize cannot be awarded for any reason. All prizes described are in Canadian currency. Taxes, if applicable, are the sole responsibility of the winner. If a prize winner’s Solutions for Small BusinessTM account is terminated or closed for any reason, any remaining parcel shipping credits will automatically be forfeited.
4.5 Before being declared an official winner, the tentative winner must properly complete and sign a declaration and release form to be provided by Canada Post (“Release Form”). The Release Form will, among other things, confirm (a) compliance with all eligibility requirements, these Official Contest Rules and all applicable laws; (b) acceptance of the prize as awarded, without substitution; and (c) release and indemnification of Canada Post from and against all liability in connection with the tentative winner’s participation in the Contest and acceptance and use of the prize. The Release Form must be returned within the time period and in the manner specified on the form or the prize will be forfeited. The Release Form will also contain a mathematical skill-testing question. Before being declared the winner of a prize, the tentative winner must first correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question.
(a) the tentative winner refuses the prize;
(b) Canada Post is unable to contact the tentative winner through email or telephone as set out in section 1.1 above;
(c) the tentative winner does not respond to Canada Post (in the manner specified by Canada Post) within ten (10) business days of being contacted by Canada Post;
(d) the tentative winner fails to correctly answer the mathematical skill-testing question posed;
(e) the tentative winner fails to return the properly executed Release Form within the specified time; or
(f) Canada Post determines that the tentative winner has not complied with these Official Contest Rules, or otherwise disqualifies the tentative winner or determines the tentative winner to be ineligible to receive the prize,
then Canada Post will select another tentative winner. Canada Post will continue that process until an official winner is declared.
4.7 If for any reason no entrants comply with these Official Contest Rules or there are no qualified or suitable entrants, as determined by Canada Post at its sole discretion, the Contest prizes will not be awarded.
5.1 By entering the Contest, you declare that you have complied with all the Official Contest Rules and met all eligibility requirements.
5.2 Your participation in this in this Contest is solely at your own risk. You are solely responsible for all costs you incur to enter the Contest.
5.3 Canada Post reserves the right, at its option, to publish any winner's name, address, photograph, likeness, voice or statements without further compensation to the winner.
5.4 You irrevocably release Canada Post from any and all claims, damages or other liability whatsoever (including without limitation damage to property, personal injury, or death) for harm you may suffer as a result of entering or attempting to enter the Contest, and, if declared a winner, from accepting and using the prize.
5.5 You agree to indemnify and hold harmless Canada Post from any claim, damages, losses, fines, penalties, settlement or other costs arising from your failure, whether intentional or not, to comply with these Official Contest Rules.
5.6 Canada Post reserves the right to withdraw, terminate or modify all or any part of the Contest by publishing a notice on the Canada Post website if for any reason the Contest is not capable of running as planned, including technical failure or corruption, computer virus, tampering, unauthorized intervention, fraud or any other cause beyond the control of Canada Post which in the opinion of Canada Post affects the administration, security, fairness, integrity or proper conduct of the Contest.
5.7 In the event of any discrepancy or inconsistency between these Official Contest Rules and disclosures or other statements contained in any Contest-related materials, these Official Contest Rules shall prevail, govern and control. These Official Contest Rules may change from time to time without prior notice and at Canada Post’s sole discretion. It is the participants’ responsibility to regularly check these Official Contest Rules to determine if there have been changes made and to review such changes.
5.8 Canada Post will monitor and audit the overall entry process. Canada Post reserves the right, at its sole discretion, to disqualify an entrant or anyone else who has tampered, or is suspected of tampering, with an entry.
5.9 The terms and conditions for the Canada Post website, including but not limited to the Canada Post Solutions for Small Business Terms and Conditions, apply to the Contest and can be found here (or any replacement website as designated by Canada Post).
6.1 Any litigation respecting the conduct or organizing of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties to reach a settlement.
